By accessing or using our website, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and our other applicable policies.
1. Acceptance of Terms
By using PreetyFashion, you agree to comply with these Terms & Conditions, our Privacy Policy, Shipping Policy, Replacement Policy, and any other policies or guidelines published on the website.
If you do not agree with any part of these Terms & Conditions, please discontinue use of the website.
2. Website Use
You agree to use PreetyFashion only for lawful purposes and in a manner that does not interfere with the operation, security, or availability of the website.
You must not attempt to gain unauthorized access to any account, system, server, database, or other part of the website, or use the website for fraudulent, unlawful, abusive, or harmful activities.
3. Products & Product Information
We make reasonable efforts to ensure that product names, descriptions, images, prices, colours, sizes, specifications, availability, and other information displayed on PreetyFashion are accurate and up to date.
However, minor differences may occur, particularly in product colour or appearance due to lighting, photography, screen settings, or device displays.
Product availability may change without prior notice. We reserve the right to correct errors, update product information, change prices, or remove products when necessary.
4. Pricing & Promotional Offers
Prices displayed on PreetyFashion are subject to change without prior notice. We may offer discounts, promotional offers, coupons, or other promotional benefits from time to time.
Promotional offers may have specific eligibility requirements, validity periods, usage limits, or other conditions. Unless otherwise stated, promotional offers cannot be combined with other offers.
In the event of a genuine pricing or listing error, PreetyFashion may contact the customer regarding the affected order and may provide an appropriate resolution, including cancellation where necessary.
5. Orders
Placing an order on PreetyFashion constitutes a request to purchase the selected products. An order may be subject to product availability, payment confirmation, address verification, and other applicable checks.
We reserve the right to cancel, refuse, or limit an order where reasonably necessary, including in cases involving product unavailability, pricing or listing errors, suspected fraud, duplicate or unusual orders, incorrect information, or violation of these Terms & Conditions.
If an order is cancelled after payment has been successfully received, any applicable refund will be processed through the relevant payment method or payment provider, subject to the applicable circumstances and policies.
6. Payments
Payments must be completed through the payment methods made available during checkout, unless Cash on Delivery or another approved payment option is specifically available for the order.
Payments may be processed through authorized third-party payment service providers. Customers are responsible for providing accurate payment and billing information.
PreetyFashion does not request customers to share sensitive payment credentials such as passwords, PINs, OTPs, or CVV details through phone calls, WhatsApp, email, or social media.
7. Shipping & Delivery
Orders are processed and delivered according to our applicable Shipping Policy.
Estimated delivery times may vary depending on the delivery location, product availability, vendor fulfilment, logistics provider, weather conditions, public holidays, and other circumstances beyond our reasonable control.
Customers are responsible for providing complete and accurate shipping information. Delays or failed deliveries caused by incorrect or incomplete information may not be the responsibility of PreetyFashion.
8. Replacement, Returns & Refunds
Replacement requests, returns, refunds, and other order-related issues are handled according to our applicable Replacement Policy and the terms applicable to the relevant product or order.
Customers should review the applicable policy before placing an order and should report eligible issues within the specified time period.
Where a product issue is attributable to a vendor, the vendor may be responsible for the applicable replacement, return, refund, or related costs in accordance with the applicable policy and circumstances.
9. Vendor Registration
PreetyFashion provides a platform through which eligible local shops, sellers, and vendors may register and offer products for sale.
Vendor registration is free of cost. No registration fee is required to create a vendor account or submit products for sale on PreetyFashion.
Vendor registration does not guarantee approval, product listing, sales, visibility, or acceptance of every submitted product.
10. Vendor Shop Name Listing
Vendors may optionally choose to have their physical shop or business name displayed or promoted through the PreetyFashion platform through our Shop Name Listing Service.
The Shop Name Listing Service carries a one-time fee of ₹500, applicable only when the vendor chooses this optional service.
Vendors who do not choose the Shop Name Listing Service will not be charged this optional listing fee.
The shop listing fee is separate from vendor registration and does not replace, reduce, or include any applicable sales commission or other separately agreed service charges.
11. Vendor Commission
A platform commission of approximately 5% to 10% may apply to successful sales made through PreetyFashion, depending on the product, category, vendor arrangement, or applicable commercial terms.
The applicable commission rate and related commercial terms may be communicated to the vendor through the relevant vendor agreement, dashboard, onboarding information, or other official communication.
Applicable commissions may be deducted or adjusted from the vendor’s sale proceeds in accordance with the applicable terms.
Any optional service charges will be communicated separately. PreetyFashion does not intentionally impose undisclosed platform charges.
12. Vendor Product Responsibility
Vendors are responsible for ensuring that products submitted or listed on PreetyFashion are genuine, accurately described, legally permitted for sale, properly packaged, and compliant with applicable laws and requirements.
Vendors must provide accurate information regarding product name, price, size, colour, material, specifications, images, availability, condition, and other relevant details.
Vendors must not list counterfeit, prohibited, unlawful, unsafe, misleading, or infringing products or content.
13. Vendor Images & Content
Vendors are responsible for ensuring that product photographs, descriptions, logos, trademarks, specifications, and other content submitted to PreetyFashion are owned by them or used with appropriate authorization.
By submitting content to PreetyFashion, the vendor grants PreetyFashion a non-exclusive permission to use, reproduce, display, modify where reasonably necessary for formatting, and promote that content for the purposes of operating, marketing, advertising, and providing the marketplace services.
Vendors remain responsible for any third-party claims arising from content or materials they submit without appropriate rights or authorization.
14. Vendor Packaging & Delivery Responsibility
Unless otherwise agreed, vendors are responsible for properly preparing, packaging, and dispatching products sold through the platform.
When vendors use their own delivery or shipping arrangements, they are responsible for the applicable packaging and delivery costs and arrangements.
If a vendor chooses to use packaging, delivery, logistics, or related services provided or arranged by PreetyFashion, applicable charges may apply. Such charges will be communicated before the service is used where reasonably practicable.
15. Vendor Order Fulfilment
Vendors are responsible for processing and fulfilling accepted orders within the applicable fulfilment period.
Vendors must ensure that the correct product, quantity, size, colour, and other order details are prepared and dispatched.
Delays, incorrect products, missing items, poor packaging, or other issues arising from a vendor’s fulfilment process may be attributable to the respective vendor and may result in appropriate action under the applicable vendor terms.
16. Vendor Account & Platform Usage
Vendors must provide accurate, complete, and current information during registration and throughout their use of the platform.
Vendors are responsible for maintaining the confidentiality of their login credentials and for activities performed through their account.
PreetyFashion may suspend, restrict, or terminate a vendor account where reasonably necessary due to fraudulent activity, misleading information, repeated order failures, prohibited products, policy violations, misuse of the platform, or other legitimate concerns.
17. Customer Accounts
Customers are responsible for providing accurate information when creating an account or placing an order.
Customers should keep their login credentials secure and should notify us if they believe their account has been accessed without authorization.
PreetyFashion may restrict or suspend an account where there is reasonable evidence of fraudulent activity, misuse, abuse, or violation of these Terms & Conditions.
18. Intellectual Property
The PreetyFashion name, logo, website design, graphics, text, software, trademarks, branding, and other original materials provided by PreetyFashion are protected by applicable intellectual property laws.
Except where permitted by law or with appropriate authorization, you may not copy, reproduce, modify, distribute, publish, sell, or commercially exploit our protected content.
19. Third-Party Services & Links
PreetyFashion may use third-party services for payment processing, shipping, logistics, analytics, communication, hosting, advertising, and other website functions.
The website may also contain links to third-party websites or services. PreetyFashion is not responsible for the content, availability, security, or privacy practices of third-party websites.
20. Website Availability
We make reasonable efforts to keep PreetyFashion available and functioning properly. However, temporary interruptions may occur due to maintenance, technical problems, hosting issues, network failures, security incidents, or circumstances beyond our reasonable control.
We do not guarantee that the website will always be available, uninterrupted, error-free, or completely free from technical issues.
21. Fraud & Misuse
Any attempt to misuse the website, create fraudulent accounts, place fraudulent orders, manipulate promotions, submit false information, interfere with website operations, or engage in unlawful activities may result in account restrictions, order cancellation, suspension, or other appropriate action.
22. Limitation of Liability
To the extent permitted by applicable law, PreetyFashion will not be responsible for indirect, incidental, special, or consequential losses arising from the use of the website or services.
PreetyFashion operates as an online marketplace/platform connecting customers and vendors. Unless specifically stated otherwise, vendors remain responsible for their products, product information, quality, packaging, fulfilment, and applicable legal obligations.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or protections that cannot lawfully be excluded or limited under applicable law.
23. Indemnification
To the extent permitted by applicable law, users and vendors may be responsible for losses, claims, liabilities, costs, or expenses arising from their unlawful use of the website, violation of these Terms & Conditions, or infringement of third-party rights.
24. Changes to These Terms
PreetyFashion may update, modify, or amend these Terms & Conditions from time to time to reflect changes in our services, business practices, technology, or applicable requirements.
Updated terms will be published on this page. Your continued use of the website after an update constitutes acceptance of the revised Terms & Conditions to the extent permitted by applicable law.
25. Governing Law
These Terms & Conditions shall be interpreted and governed in accordance with the applicable laws of India, subject to the jurisdiction of the appropriate courts.
